What is an Injunction?

In difficult situations, the court can issue injunctions to help protect you, your children, or your home. An injunction can:

  • Prevent someone from using or threatening violence

  • Prohibit unwanted contact or communication

  • Exclude a person from entering or living in your home

Types of Injunctions

Non-Molestation Orders

A civil order designed to prohibit an associated person from harassing, threatening or being violent towards you or your children. A breach of a non-molestation order is a criminal offence.

Occupation Orders

Determines who can remain living in a property or define who can enter, restrict or exclude an associated person from a property or certain parts of the property. As such, these orders can exclude someone from the property altogether or limit their access, even if they are the legal owner.

Prohibited Steps Orders

A Court Order preventing a person (usually a parent / someone with parental responsibility) from taking certain steps or making a decision about a child without the permission of the other parent or the Court. Examples include changing a child’s surname, removing a child from the UK, changing a child’s school.

Forced Marriage Protection Orders (FMPOs)

Can assist if a person is being forced into a marriage or already in a forced marriage. This Order can prevent a marriage from taking place, requiring passports to be surrendered to stop a person being taken out of the UK and / or restrict contact with an associated person.

Injunctions FAQs

A Non-Molestation Order is a civil order designed to prohibit an associated person harassing, threatening or being violent towards your or your children. A breach of a non-molestation order is a criminal offence.

Yes. A ‘without notice’ injunction can be made as an emergency court order which shall be granted immediately to prevent imminent harm or destruction of evidence, without informing the associated person that the person requires protection from.

A Non-Molestation Order typically is in place for a period of 6 to 12 months although they can be granted for longer, or in exceptional cases, for an indefinite period. A Non-Molestation Order can be extended should the harassment complained of still continues.

Yes. A Non-Molestation Order can be contested or applied to be removed (discharged). In order to challenge the order, you must prove that the allegations made are false by providing the Court with evidence. The Non-Molestation Order will be discharged if you are successful.

An injunction will not appear on a basic background check. However, if the injunction is breached, any resulting criminal conviction will.
