Family Law FAQs

We advise on all legal matters affecting family life including divorce, finances, children, domestic abuse, cohabitation and protective agreements.

While it’s not a legal requirement, professional advice can help protect your interests and avoid costly mistakes, especially around finances and matters relating to children.

You don’t automatically have rights like married couples – even if you’ve lived together for a long time and have children.

So having a legal document like a cohabitation agreement can be useful, alongside a will, if one of you becomes seriously ill, dies or if you split up. It will protect you both, and any other family members who’ll be affected.

For example, an agreement can make sure you have:

  • a share of each others’ assets
  • access to each others’ state pension
  • next of kin rights in a medical emergency
  • Even if you are not married, there are ways to make sure that you and your partner are protected. You could consider:

    • A Cohabitation Agreement: to set out your financial arrangements while you live together.
    • A Declaration of Trust: to clarify who owns what if you buy property together.
    • A Will: to ensure your wishes are followed and your partner is provided for.

Taking these steps can give you peace of mind and help avoid misunderstandings or costly disputes in the future.

In the UK, “custody” is no longer a legal term. The correct term is a Child Arrangements Order, which sets out where a child lives and how they spend time with each parent. The updated terminology helps reduce conflict and keeps the focus on the child’s welfare. Parents can agree arrangements themselves or ask the court to decide if needed.

There are different ways of funding a family law case: Fixed Fee: At Franklins Solicitors we charge a fixed fee for an initial consultation with one of our experienced family law professionals to discuss your matter in person or by virtual means. Hourly Rate: Upon formally instructing the firm, you will be charged the hourly rate of your designated family law professional whereby you will be billed usually once a month. Your bill will set out the work that the solicitor has undertaken on your matter. We will provide you with a formal estimate of your costs at the start of your matter within our client care documentation and we will keep that estimate under review as your matter progresses.
