Family Law FAQs

Family Law FAQs

We advise on all legal matters affecting family life including divorce, finances, children, domestic abuse, cohabitation and protective agreements.

While it’s not a legal requirement, professional advice can help protect your interests and avoid costly mistakes, especially around finances and matters relating to children.

You don’t automatically have rights like married couples – even if you’ve lived together for a long time and have children.

So having a legal document like a cohabitation agreement can be useful, alongside a will, if one of you becomes seriously ill, dies or if you split up. It will protect you both, and any other family members who’ll be affected.

For example, an agreement can make sure you have:

  • a share of each others’ assets
  • access to each others’ state pension
  • next of kin rights in a medical emergency
  • Yes. For divorcing couples and civil partners, a financial settlement can be formalised in a consent order approved by the court.

Unmarried couples may formalise agreements through a separation agreement or, where appropriate, a legally binding deed or court order relating to property or children.

If you are married or in a civil partnership, the court can decide how property is divided.

If you are unmarried, ownership and any legal agreements will usually determine how the property is dealt with. Disputes may be resolved through negotiation or through the civil courts if necessary.

Unmarried couples do not have the same automatic financial rights as married couples or civil partners. Financial claims are usually based on property ownership, trust law or arrangements relating to children. It is important to seek early legal advice to understand your position.
