Divorce ends your legal marital relationship with your spouse but it does not sever your financial ties. A Financial Remedy Order or Consent Order can be put in place to separate your marital assets between you and your spouse.

You have an obligation to disclose full and frank financial disclosure of all material facts, documents and other information in relation to your issues. This obligation is ongoing throughout financial disclosure and is essential to reduce costs and to clarify any issues at any early stage. Failing to disclosure fully are severe and can lead to serious consequences.

A 50/50 split is not guaranteed when separating your finances. The court will have consideration to all the circumstances in each particular case which includes the available assets, the needs of each party, age and duration of the marriage, standard of living, and contributions to the marriage and conduct. The aim of the court is to ensure fairness between the parties and for the assets to be shared equally unless a departure from that equality is required.

Whether the house is owned by one or both of you, the court can consider a number of orders to ensure that both parties are housed adequately. The court can order the sale of a property, transfer it to one partner, or delay the sale until a specified event (e.g. a child attaining the age of 18 or full time education

If the debt was incurred for family benefit, both partners may be jointly responsible, even if the debt is in one name only.
