We act on behalf of a large local company and deal with a wide range of legal matters on their behalf. Recently the Client made the decision to close one of their offices which would affect 6 employees.
All of the employees had mobility clauses within their contract of employment. As such, the company were going to simply rely upon the mobility clause and request the employees move branch. After reviewing the matter on behalf of the company, we advised them in relation to the procedure for redundancy rather than simply relying on the mobility clause which could potentially have resulted in claims against the company for constructive dismissal and/or unfair dismissal on an automatic basis, i.e. with no defence.
As a result, all 6 employees went through the redundancy process and were successfully transferred to the new offices.
