What does the Executor of a Will have to do?
As the Executor of a Will, you are legally responsible for handling the deceased’s estate, including distributing their assets as specified in the Will and paying any outstanding bills and taxes, including inheritance tax.
What happens if there is no Will?
Where there is no Will, the deceased is said to have died “intestate”. Who inherits is then normally determined by the law, rather than what the deceased’s wishes might have been. Exactly who inherits will depend on whether there is a surviving spouse, civil partner or children (including both biological and adopted children, but not stepchildren).
Where there is no surviving spouse, civil partner or children, other close relatives may be able to inherit. If there are no sufficiently close relatives, the deceased’s whole estate will normally go to the Crown.
Can you dispute a Will?
You may be able to challenge a Will if you think it is unfair, but the grounds for doing so are limited. These include if you believe the Will was not created in a legally sound manner and, in some circumstances, if you are a child of the deceased who has been disinherited, or given a particularly small inheritance relative to the size of the estate. However, such challenges are often complicated and there is no guarantee of success.
