The Court will list a time and date as to when your case will be heard. The hearing will usually take place in the Judges chambers office. Prior to the trial the Judge will have read all the papers relating to the claim and will be familiar with it.
A small claims track trial is designed to be user friendly and therefore a lot of the usual formalities of a trial are dispensed with. This is to encourage the parties to represent themselves without the need to use solicitors or barristers.
If we believe that a barrister should represent your interests at a trial we will discuss this with you beforehand and give you an estimate of their expected fees.
Each party will put forward their version of events to the Court and each will have an opportunity to cross examine the other on their version. The Judge during the trial may wish to ask his or her own questions. At the conclusion of the trial the Judge will make a decision which the parties must abide by.
