Once the Court has received the documents they will serve these on the debtor at the address given on the Claim Form. They will also return a sealed copy i.e. copies stamped by the Court to us. The Court also confirms what date the claim is said to have been served on the debtor regardless of when the debtor actually claims to have received the documents. At this point the Court will also send us a form called Request for Judgment dealt with below.
Progress of proceedings
The debtor then has several options open to them; they can either:
- Pay the whole of the debt.
- File an Acknowledgement of Service: this gives them 28 days from the date of service to file a defence.
- Dispute the whole of the claim: in order to do this they must file a Defence at Court in which they state their reasons for disputing the debt. The Court will send us a copy of the Defence and you then decide whether to continue with the claim see defended claims section.
- Admit the whole of the debt: the debtor will complete an admission form and we can then enter Judgment against them see below.
- Admit that some of the debt is owed but dispute the rest: again the Court will send us their response and you will have to decide how you want to proceed.
- Make no response to the Claim: you can ask the Court to enter Judgment against the debtor.
