Three types of Grant:

It will be necessary for the Executor/Personal Representative of the estate to obtain a Grant of Representation.

What is a grant of representation?

If a deceased estate is worth in excess of £5,000.00, it will be necessary for the Executor/Personal Representative of the estate to obtain a Grant of Representation in order to deal with the deceased’s assets. There are three types of Grant:

  • Grant of Probate – This is normally only issued to the Executor/s appointed under the Will of the deceased.
  • Letters of Administration with Will annexed – This is appropriate where there is a Will but for some reason it is not possible to issue a Grant of Probate to an Executor.
  • Letters of Administration – This Grant is issued where the deceased has died intestate.

Why is a Grant of Representation needed?

As stated above, it will not be possible to deal with certain assets without a Grant. Banks and Building Societies will not release monies held in the deceased’s account without production of the Grant and it may also be necessary in order to sell the deceased’s property or transfer into a beneficiary’s name.
