If your debtor refuses to comply with a Judgment or Order of the Court then there are a number of options available for you to enforce this against them. More than one method can be used at the same time.
Providing the debtor is employed, an order can be sought that directs his or her employers to make periodical deductions from his earnings. An attachment of earnings order may be made in respect of wages, fees, bonuses, commission, overtime, statutory sick pay and occupational pensions payable under a contract of service. An order cannot be made in respect of self-employed income, state pensions, benefits or allowances.
When deciding the rate at which deductions will be made the Court will take into account how much the debtor needs to maintain his or her family. The debtor is under a duty to notify the Court of any change in his or her employment. Should the debtor change jobs it will be necessary to start this process again so that the Order can be sent to the new employer.
