How do I apply for probate?

It is possible for the Executor to apply personally at the Probate Registry.

It is likely that you will require the assistance of a Solicitor in order to obtain Probate. Our experienced and friendly Probate department will be able to assist in the following:

  1. Valuing the assets and liabilities of the deceased’s estate.
  2. Finalising the tax affairs of the deceased.
  3. Contacting and tracing the beneficiaries of the estate.
  4. Advising on the terms of the deceased’s Will or if there is no Will applying the Intestacy rules to the estate.
  5. If the estate is over the Inheritance Tax Threshold, then an IHT200 Inheritance Tax return will need to be completed.
  6. Preparing an Oath for Executors and submitting this to the Probate Registry.
  7. Distributing the estate in accordance with the terms of the Will.

We will have an initial meeting with you to discuss the deceased’s estate and give you an idea of the work involved in order for you to administer the estate. We will provide you with costs information from the outset so that you are aware of the fees involved.
