Once proceedings have been served upon the proposed Defendant they have one of three options available to them
Disputed Claims
Once proceedings have been served upon the proposed Defendant they have one of three options available to them.
- Pay the amount claimed: admit liability for the claim and offer to make payments to settle the debt, often by instalments.
- Dispute the claim: deny that they owe either all or part of the debt.
- Dispute the claim and put forward a counterclaim: deny that they owe the debt and also claim that you owe them a debt.
Disputed Claims
If the Defendant wishes to dispute the claim they must file a Defence at Court within 14 days of service of the Claim Form. The Court will then forward a copy of the Defence to us.
The Defence will usually deal with the allegations that have been put forward in the Particulars of Claim by either admitting or denying each of them in turn. Where the allegations are denied the Defendant must give a reason.
